العدول عن الأصل إلى ما جرى به العمل عند المالكية؛ أسبابه وضوابطه The Departure From The Original To What Was Done By The Work Of The Malikis; Its Causes And Controls

الملخص
يَروم هذا البحث بيانَ سَبَــــبِــيَّة أصل" ما جرى به العمل" عند المالكية في العدول عن القول المشهور أو الراجح في المذهب؛ مُعَرِّجًا على أسباب إعمال هذا الأصل ــــــ وهي أسباب مصلحيّة في الغالب تُدرَكُ بتحقيق الـمناط ــــــ، مُبْـرِزًا ضوابط العدول إليه؛ والتي تتمثّل ابتداءً في ضوابط ما يَستنِد إليه من الأدلة والقواعد، ثُـمَّ فـي ما خَصَّه بــه الـمالكية من شروط؛ مَنْعًا للـتّـفلُّت في هذا الباب، وصِيانــةً لأحكام الشرع الـحنيف بتوجيه عملية الاجتهاد والفتوى إلى ما يوافِق مقاصد الشارع الحكيم، مع إعطاء أمثلة فقهية حول هذا الأصل. This research aims to explain the originalreason of what was done by the Malikis’ work, in deviating from the most correct saying thought of the Malikis School ;by mentioning the reasons which are mostly expediency and are realized by the achievement of the context for applying this principle ( origin). Highlighting the terms and the conditions of deviating to this origin which is represented first in the conditions of what the evidences and rules are based on then in the unique conditions of the Malikis; In order to prevent slipping in this section and to preserve the provisions of the Sharia law and the Islamic Religionas a hole by directing the process of ijtihad and fatwa, according to the purposes of the Almighty God, by giving examples about this principle (origin).
