Abstract
يعتبر الأمن القانوني دعامة أساسية ترتكز عليها دولة القانون خصوصا في الحقل الاقتصادي ، و على وجه الخصوص قطاع الاستثمارات ، القائم على مبـادئ تجسـد تطــبيق حرية اقتصادية مكرسة دستوريا وفقا للمادة 61 للتعديل الدستوري الجزائري لسنة 2020 و المتبني لنظام اقتصاد السوق الحر ، و المتمثلة في حرية التـجارة و الاسـتثمار . إن فعالية النشاط الاستثماري باعتباره أهم القطاعات الحيوية لتحسين الوضعية الاقتصادية مرتبطة بمدى التزام الدولة بمنح ضمانة الاستقرار القانوني للتشريعات المتعلقة بالاستثمار وهذا ما سنلمسه في القانون الجديد لسنة 2022 المتعلق بالاستثمار، سعيا من المشرع لاستقطاب المستثمرين بما فيهم الأجانب و تجنب للتصنيف الرمادي الدولي للقطاع الاستثماري. Legal security is considered a fundamental pillar upon which the state of law rests, especially in the economic field, and in particular the investment sector, which is based on principles that embody the application of economic freedom constitutionally enshrined in accordance with Article 61 of the Algerian Constitutional Amendment of 2020 and the adoption of the free market economy system, which is the freedom of trade. and investment . The effectiveness of investment activity as the most vital sectors for improving the economic situation is linked to the state’s commitment to granting a guarantee of legal stability to investment-related legislation, and this is what we will see in the new law of 2022 related to investment, in an effort by the legislator to attract investors, including foreigners, and avoid the international gray classification of the investment sector.
