مكانة المسن داخل الأسرة بين الرعاية والحماية القانونية على ضوء التشريع الجزائري

الملخص
تعد الأسرة بمثابة الوحدة الأساسية التي يقوم عليها هيكل المجتمع، كونها دعامة متينة للمجتمعات السليمة. ويعتبر الشخص المسن أحد أفرادها ومع تقدمه في العمر تطرأ عليه مجموعة من التغيرات والمشكلات النفسية والجسمية التي تحد من مكانته الإجتماعية من جهة و تخل بأدواره داخل الأسرة التي ينتمي إليها من جهة أخرى، ما يجعله بحاجة ماسة إلى الرعاية والإهتمام ومحاولة تجديد مهامه ومشاركاته الفعالة في الأسرة والمجتمع وهذا للحفاظ على مكانته و تعزيزها. وتعتبر فئة المسنین من الفئات الھامة في المجتمع التي كرست التشریعات الدولیة والوطنیة حمایتھا، وذلك بالنظر إلى خصوصیة المرحلة العمریة التي یعیشھا الشخص المسن. وعليه جاءت دراستنا هذه لمعرفة دور الأسرة في الرعاية الاجتماعية للمسن من خلال العلاقات والمكانة الاجتماعية، وماسنته التشريعات والقوانين لحماية هذه الفئة، وكذا التطرق لمعالجة أهم المشاكل الاجتماعية للمسن. Abstract: The family is the basic unit on which the structure of society is based, as it is a solid pillar of healthy societies. The elderly person is considered one of its members, and with his advancing age, a group of changes and psychological and physical problems occur to him that limit his social status on the one hand and disturb his roles within the family to which he belongs on the other hand, which makes him in dire need of care and attention and an attempt to renew his tasks and active participation in the family. society and this is to maintain and enhance its status. The elderly group is considered one of the important groups in society that international and national legislation has devoted its protection to, given the privacy of the age stage experienced by the elderly person. Accordingly, our study came to know the role of the family in the social care of the elderly through relationships and social status, and what legislation and laws enacted to protect this group, as well as addressing the most important social problems of the elderly.
