الحماية القانونية للتراث الثقافي المادي في القانون الجزائري

الملخص
التراث الثقافي هو مرآة عاكسة لحضارة الأمم وتاريخها، وتنوع التراث الثقافي يساعد على الكشف عن ثقافة وتفكير الشعوب، ويختزل هوياتهم في مخرجات التراث الثقافي، وتهدف هذه الدراسة إلى الكشف على الحماية التي وفرتها الدولة الجزائرية لحماية الممتلكات الثقافية سواء على ترابها أو مياهها الإقليمية، وقد توصلت الى عدة نتائج مفادها أن التراث المادي له أهمية اقتصادية سياحية تفيد الدولة من جهة لسهولة الترويج له، وأهمية ثقافية واجتماعية تجذب المهتمين بالثقافات والدراسات الإجتماعية والإنسانية، وقد وفرت الحكومة الجزائرية حماية قانونية للتراث الثقافي المادي منها: حماية مؤسساتية، ادارية وجنائية، وأوضحت كيفية تسجيل وتصنيف ممتلك ثقافي ما. Cultural heritage is a mirror reflecting the civilization and history of nations, and the diversity of cultural heritage helps to reveal the culture and thinking of peoples, and reduces their identities to the outputs of cultural heritage, and this study aims to reveal the protection provided by the Algerian state to protect cultural property, whether on its soil or territorial waters, and has reached several conclusions that material heritage has a tourist economic importance that benefits the state on the one hand for its ease of promotion, and cultural and social importance that attracts those interested in cultures and social and human studies, and has provided The Algerian government has legal protection of tangible cultural heritage, including institutional, administrative and criminal protection, and has clarified how to register and classify a cultural property.
