المفاوضات في عقود نقل التكنولوجيا

الملخص
خلصت هذه الدراسة إلى أن عقود نقل التكنولوجيا هي عقود مستحدثة ذات أهمية بالغة، أخذت جانبا متميزا في مجال تنشيط التجارة الدولية؛ استجابة لمتطلبات التنمية الاقتصادية للدول النامية التي تسعى لإبرامها بدا بمرحلة المفاوضات التي يتناول خلالها طرفي التفاوض سلسلة من الاتفاقيات التمهيدية وتضمين هذه العقود ببنود تحقق التوازن العقدي بالنسبة للالتزامات الملقاة على كليهما لتفادي وقوع مشكلة قانونية مستقبلا في ظل وجود قصور تشريعي جلي ينظم مرحلة المفاوضات سواء على المستوى الوطني أو الدولي. This study concluded that technology transfer contracts are innovative contracts of critical importance, taking a distinct aspect in the area of revitalization of international trade in response to the economic development requirements of developing countries that strive to conclude them. It starts from the negotiation phase during which the parties to the negotiation deal with a series of preliminary conventions, in addition to including in these contracts clauses that achieve the contractual balance of obligations imposed on both parties in order to avoid a future legal problem in the light of a clear legislative shortcoming governing the negotiation phase at both the national and international levels.
