الملخص
تعقبات القاضي ابن عبد البر على أهل الظاهر في كتابه الاستذكار ( باب المعاملات) Judge Ibn Abd al-Barr's Followings up of Zahirites in his Book Entitled Al-Istithkar الملخص أوجدت حالة المنافسة المذهبية في الأندلس صورا من المناظرات والمناقشات والتعقبات بين السادة المالكية والسادة الظاهرية كان للحافظ ابن عبد البر(ت463ه) القدح المعلى فيها خاصة أنه عاصر في حياته ابن حزم الظاهري (ت456ه) الذي حمل لواء المذهب الظاهري في الأندلس وأبلى بلاء حسنا في الدعوة له، والرد على مخالفيه. إن دراسة التعقبات توفر رحابة للتفقه والنظر، وفرصة للمقارنة والتدبر فهي في مجملها مناظرة مفتوحة يحاول كل فقيه فيها إثبات صواب رأيه بالدليل والبرهان، والحجة والبيان. وتميزت تعقبات ابن عبد البر للظاهرية بعدم ذكر أسماء علمائهم إلا إمامهم داود، واستعمل في تعقباته ألفاظا تدل على السماحة قياسا بألفاظ من عاصره من الظاهرية. و انحاز الإمام ابن عبد البر إلى المشهور من مذهب الإمام مالك في ترجيحاته ذاكرا الدليل موضحا الدلالة معقبا على رأي الظاهرية بما يؤكد مجانبته للصواب . الكلمات المفتاحية : ابن عبد البر، الاستذكار، الظاهرية، التعقبات. Judge Ibn Abd al-Barr's Followings up of Zahirites in his Book Entitled Al-Istithkar abstract The state of sectarian competitiveness in Andalusia created forms of debates, discussions and follow-ups between the Malikis and the Zahirites. Al-Hafiz Ibn Abdul-Barr (d. 463 AH) had the upper hand in it, especially that he was a contemporary of Ibn Hazm al-Zahiri (d. 456 AH), who carried the banner of those scholars who stuck to the surface reading of the verses of the holy Quran and the prophet's saying in Andalusia and did a good job in defending and calling people for Islam, and he successfully responded to the opponents of Islam. The study of followings up (tracings) provides a space for jurisprudence and consideration, and an opportunity for comparison and reflection. In their entirety, these followings up constitute an open debate in which every jurist tries to prove the supremacy of his opinion citing evidences, proofs, and arguments. Ibn Abd al-Bar’s tracings of al-Zahiriyah were distinguished by not mentioning the names of their scholars except for their imam Dawood, and he used in his followings up words that indicate tolerance in comparison with the words of his contemporaries from al-Zahiriyah .And Imam Ibn Abd al-Barr sided with the well-known view of Imam Malik in his weighings, mentioning the evidence, explaining the significance, and commenting on the opinion of the Zahirites, confirms that they were mistaken in their judgements.
