مسؤولية مشغل الرحلة التجارية الفضائية تجاه الشخص الطبيعي المشارك فيها "دراسة في القانون الإماراتي"

الملخص
تفترض حداثة الأنشطة الفضائية عدم الإحاطة الكاملة بالمخاطر المحيطة بها، وتزداد مخاطر هذه الأنشطة بمشاركة الإنسان فيها من خلال القيام بالرحلات التجارية الفضائية والتي لا يمكن توقع ما يمكن أن تواجهه بعد انطلاقها في الفضاء الخارجي، وهذا بدوره كان محط اهتمام التشريعات التي نظمت هذه الأنشطة في سبيل ضمان استمرار هذه الأنشطة من جهة وضمان مصالح الأطراف التي تقوم بها ومن يشارك فيها من جهة أخرى، ونظراً لخطورة المشاركة في هذه الرحلات فإن هذا البحث يتناول بالدراسة مسؤولية مشغل الرحلة التجارية الفضائية تجاه الشخص الطبيعي المشارك فيها. وقد تم تقسيم البحث إلى مبحثين فضلاً عن المقدمة والخاتمة حيث يتناول المبحث الأول ماهية الرحلات التجارية الفضائية في حين يتناول المبحث الثاني حالات قيام مسؤولية مشغل الرحلة التجارية الفضائية تجاه الشخص الطبيعي المشارك فيها وفق القانون الاتحادي رقم (12) لسنة 2019 في شأن تنظيم قطاع الفضاء في دولة الامارات العربية المتحدة. The novelty of space activities assumes a complete lack of awareness of risks surrounding them. The risks of these activities increase with human participation in them through commercial space flights because the risks they may face after launching into outer space are not predictable .This in turn, was the main interest of the legislations that organize these activities in order to ensure the continuity of these activities on one hand, and the interests of the parties that carry them out and participants on the other hand. This research will study the responsibilities of the commercial space flights operator toward participants after taking the risks of these flights in consideration. It has been divided into two sectors in addition to the introduction and conclusion where the first topic deals with the nature of commercial space flights. While the second topic deals with cases of the responsibility of the commercial space flight operator towards the natural person participating in it, according to Federal Law No. (12) of 2019 regarding the regulation of the space sector in the United Arab Emirates.
