الملخص
ملخص: يناقش موضوع البحث فكرة التعويض عن الإصابات الرياضية في أهم رياضة وهي كرة القدم، إذ تُعتبر من أكثر الألعاب التي يَتعرض فيها اللاعبون للإصابات، وتختلف هذه الإصابات من حيث الشدّة والموقع والمركز ومكان حدوث الإصابة. وتمثًلت إشكالية الدراسة من خلال التساؤل الرئيسي وتفرعاته في أنه: هل للتعويض عن الإصابة الرياضية في كرة القدم مبلغ محدد؟ وما أسس تقديره؟ وما الحقوق المقررة للمصاب في كل من القانونين الإماراتي والمصري؟ وهل يشمل التعويض الضرر المادي والمعنوي للاعب عند إيذائه، وأفراد أسرته حال وفاته؟ وما هي جهة الاختصاص في دعاوى إصابات كرة القدم؟ وهل تعد إصابة عمل؟ وما موقف القانون والقضاء والفقه من تكييفها القانوني؟ واتبًع الباحثان المنهج الوصفي التحليلي والمقارن بين التشريع الإماراتي والمصري. وتقسيم خطة الدراسة إلى مبحثين: أولهما: الاصابات الرياضية في كرة القدم، والثاني آثار الإصابة الرياضية في كرة القدم. وخلصت الدراسة إلى مجموعة من النتائج والتوصيات يأمل الباحثان أن تشكلا نواة لأبحاث مستقبلية، تركز على الجوانب القانونية في هذه الرياضة، وتسهم بشكل فعًال في تطوير تشريعاتنا العربية. Summary: The search topic discusses the idea of compensation for sports injuries in the most important sport, namely football, which is considered one of the most vulnerable games in which players are most exposed to injuries. These injuries vary in terms of severity, location, position and where the injury occurs. The study issue was the main question and its sub-questions: is it a specific amount to compensate for sports injury in football? What are the grounds for the evaluation? What are the rights of the injured in both the UAE and Egyptian laws? Does the compensation include material and moral damage to the player when he is harmed, and his family members upon his death? What is the jurisdiction of football injury claims? Is it a work injury? What is the law's judicial position and jurisprudence on its legal adaptation? The researchers followed the descriptive, analytical and comparative approach between the UAE and Egyptian legislation. Divide the study plan into two researchers: the first: sports injuries in football, and the second the effects of sports injury in football. The study concluded with a set of results and recommendations, which the researchers hope will form the core for future research, focusing on the legal aspects of this sport, and effectively contributing to the development of our Arab legislation.
