النظام القانوني لقاضي التحقيق المكلف بالأحداث في التشريع الجزائري The Legal System Of The Investigation Judge In Charge Of Juveniles In Algerian Legislation

الملخص
يعد الطفل من أكثر الفئات هشاشة وتعرضا للخطر في المجتمع، وقد ذهبت معظم التشريعات المقارنة إلى أن الحداثة تعتبر مرحلة حرجة وحساسة بالنسبة للطفل عموما، ولابد من أن يحاط بالاهتمام وخصوصا حين الاشتباه فيه وقبل تحريك الدعوى العمومية ضد، وقد أولى المشرع الجزائري لفئة الأحداث عناية خاصة، وذلك بإفرادهم بمعاملة خاصة مختلفة عن معاملة المجرمين البالغين، حيث طبق عليهم تدابير ملائمة لهم لإصلاحهم وتهذيبهم وإعادة إدماجهم في المجتمع. كما طبق عليهم إجراءات خاصة تبدأ بإنشاء محاكم خاصة للفصل في المسائل المتعلقة بالأحداث، حيث يشرف عليها قضاة متخصصون في شؤونهم، ومنهم قاضي التحقيق المكلف بالأحداث كما هو منصوص عليه في القانون رقم 15-12 المتعلق بحماية الطفل وهو موضوع دراستنا، أما من حيث تنفيذ الحكم الجزائي فقد خصص المشرع الجزائي مؤسسات ومراكز خاصة بالأحداث بغية إعادة تأهيلهم. The child is one of the most vulnerable and at risk groups in society, and most of the comparative legislations have stated that modernity is considered a critical and sensitive stage for the child in general, and he must be surrounded with attention, especially when he is suspected and before the public lawsuit is initiated against, and the Algerian legislator has given the juvenile category special attention By providing them with a special treatment different from the treatment of adult criminals, as appropriate measures have been applied to them to reform, discipline and reintegrate them into society. Special procedures have also been applied to them that begin with the establishment of special courts to adjudicate matters related to juveniles, where they are supervised by judges specializing in their affairs, including the appointed investigating judge Juveniles as stipulated in Law No. 12-15 related to child protection, which is the subject of our study. As for the implementation of the penal ruling, the penal legislator has designated special institutions and center Juveniles in order to rehabilitate them.
