الملخص
يتضمن هذا البحث اختصاصات المحكمة الدستورية المتعلقة بالانتخابات خاصة ما تعلق بالانتخابات الرئاسية والاستشارات الاستفتائية والانتخابات البرلمانية، وفقاً لما نص عليه الدستور الجزائري لسنة 2020 وكذا القانون العضوي رقم 21-01 المتعلق بنظام الانتخابات المعدل والمتمم، والوقوف على النقائص والثغرات الموجودة، واقتراح الحلول المناسبة، خاصة بعد التجربة السابقة التي خاضها المجلس الدستوري منذ نشأته سنة 1963 وتطور بعد تعديل الدستور سنوات 1989 و1996 و2016، وبالتالي يجب تبيين الدور الذي يجب أن تضطلع به المحكمة الدستورية بخصوص الانتخابات بدقة ووضوح. This research includes the competences of the constitutional court relating to elections, in particular those relating to presidential elections, referendum consultations and legislative elections, , in accordance with what was stipulated in the Algerian constitution for the year 2020 as well as the organic law No. 21-01 relating to the electoral system modified and supplemented, identifying the existing gaps and flaws, and proposing appropriate solutions, especially after the previous experience of the Constitutional Council since its creation in 1963 and its evolution after the modification of the constitution in the years 1989, 1996 and 2016. Therefore, the role that the Constitutional Court must play in matters of elections must be clearly and precisely explained.
