الرقابة القضائية على النظام القانوني في دول المغرب العربي ( الجزائر، تونس، المغرب )

الملخص
الملخص: تتفق دول المغرب العربي الجزائر وتونس والمغرب على أن عملية إعداد القوائم الانتخابية هي أول مرحلة في العملية الانتخابية، وتعد من الشروط الشكلية، حيث لابد أن يتوفر هذا الشرط الشكلي لكي يجوز ممارسة الحق الانتخابي لكل مواطن، لذا تمثل القوائم الإنتخابية في كل هذه الدول الحجر الأساس في النظام الإنتخابي برمته حيث تتوقف صحة وسلامة هذا الأخير على مدى مصداقية ودقة هذه القوائم، والتي من خلالها تتحدد الهيئة الناخبة المعبرة عن إرادة الأمة في اختيار رجال السلطة العامة . وأجمعت التشريعات الإنتخابية لدول المغرب العربي، الجزائر والمغرب وتونس، بإلزام السلطة المختصة في تنظيم عملية الإنتخاب بالإشراف على إعداد قوائم الإنتخاب، بهدف حصر الأفراد الذين لهم حق ممارسة حق التصويت، واستبعاد المحرومين أو الذين لم يشملهم قانون الإنتخاب . Synopsis : The Arab maghreb countries ( Alegria , Tunisie, Morocco) agress that the process of preparing of preparing electoral lists is the first stage in the the electoral process, and considere as the formal conditions, as this formal condition must be met in order to allow the exercies of the electoral right of every citizen, so the electoral lists in these countries represent the cornerstone of the entier electoral system where the health and safety of the latter depends on the credibility and accuracy of the these lists, through which the electoral body expressing the will of the nation is determined in the selection of public authority men . The electoral legislations of the meghreb countries, Algerie, Tunisia, Morroco, were unanimous in obliging the competent authority in organizing the competent in organizing this process to supervise the preparation of election lists, in order to limit individuals who have the right to exercies the vote, and exclude the disadvantaged and not covered by the electoral law.
