الملخص
ملخص: بإصدار النص المتعلق بالتعديل الدستوري ونشره في الجريدة الرسمية للجمهورية يوم 30 ديسمبر 2020، برز إلى الوجود العديد من التساؤلات الخاصة بالأحكام المتعلقة بإصدار التعديل الدستوري، خاصة في ظل طول المسافة الزمنية الفاصلة بين يوم الاستفتاء ويوم صدور التعديل. ولعل من بين أكثر المصطلحات الدستورية إثارة للاختلاف والجدل مصطلح "الإصدار"، فالاختلاف حوله يبرزت حقيقة الصراع الدائر بين البرلمان وبين رئاسة الدولة منذ بدايات نجاح الثورات في أوربا، ولا زال هذا الاختلاف قائما إلى اليوم على مستويات عدة، أولها تعريفه، وثانيها طبيعته القانونية، وثالثها وجوبه. Abstract: : Through issuing the text which is related to the constitutional amendment and publishing it in the official gazette of the Republic on December 30, 2020 , this amendment must be applied. The lengh of time distance between the day of referendum and the day it is issued may highlight the idea of the deep understanding of the relevant judgments to issuing the constitutional amendment. Besides this, one from the most exciting constitutional terms that make difference and controversy the term “Issue”. The disagreement about this term shows the truth of the ongoing conflict between the parliament and the state presidency since the beginning of the success of the revolutions in Europe. This disagreement is still exist till now on several levels; its legal nature. Thirdly, its obligation.
