الضمانات المكرسة لتشجيع الاستثمارات في الجزائر وفقا للقانون 22-18

الملخص
تتجه الجزائر نحو اعتماد مجموعة عمليات منظمة للإصلاح الاقتصادي بهدف تحقيق تنمية شاملة قابلة للاستمرار و الترقية تتجاوز بها مختلف الاختلالات السابقة. و يعتبر توسيع دائرة الاستثمار أبرز هذه العمليات التي لابد أن ترتكز على جملة من الآليات لاسيما ما تعلق منها بدولة القانون في المجال الاقتصادي و ضمان حرية المبادرة و الشفافية، دخول معترك التعاون الاقتصادي الدولي التي حرصت الدولة على تكريسها من خلال قانون الاستثمار الجديد 22-18. نتناول في هذا البحث أبرز المستجدات التي تضمنها هذا القانون و التي تقوم على الشفافية و تحرير روح المبادرة نحاول مناقشة حدود نجاعتها و فعاليتها في توفير المناخ المناسب للاستثمارات المحلية و الأجنبية بالقدر الذي يحقق تنويع في الاقتصاد ضمن رؤية شاملة و مستقرة. و نخلص إلى أن هذه المستجدات تحمل تحفيزات فعالة من حيث اعتماد المبادئ الدستورية، حماية المستثمرين و عن تعميم الرقمنة و التكنولوجيات الحديثة، محاربة البيروقراطية و تحرير المشاريع. . Abstract: Algeria is moving towards adopting a set of organized economic reform operations with the aim of achieving comprehensive sustainable development and promotion by which it overcomes the various previous imbalances. The expansion of the investment circle is considered the most prominent of these processes, which must be based on a set of guarantees and mechanisms, especially those related to the rule of law in the economic field and ensuring freedom of initiative and transparency, entering the battlefield of international economic cooperation and other considerations that the state has made every effort to enshrine them through the new investment law 22-18. In this research, we discuss the most prominent developments included in this law, which are based on transparency and liberalization of the spirit of initiative, and we try to discuss the limits of its efficacy and effectiveness in providing the appropriate climate for local and foreign investments to the extent that it achieves diversification in the economy within a comprehensive and stable vision. We conclude from the discussion that these developments carry very effective incentives in terms of adopting constitutional principles and protecting resident and non-resident investors, as well as generalizing digitization and modern technologies, noting that these developments also seek to combat bureaucracy and liberalize investment projects.
