الضمانات الموضوعية المكرسة في القانون 09/16 لترقية الاستثمار وخلق مناخ استثماري مشجع

الملخص
وضعت الجزائر منذ تبنيها نظام اقتصاد السوق ترسانة قانونية بشأن تطوير الاستثمار كان آخرها القانون 16/09 المتعلق بترقيته، وذلك لغرض استقطاب أكبر قدر من الاستثمارات الأجنبية. وتهدف هذه الدراسة إلى إبراز مختلف الضمانات الموضوعية المكرسة في هذا القانون وإبراز سياسة الجزائر ومدى وقوفها على تفعيل هذه الضمانات من الناحية العملية ومدى نجاحها في تذليل العوائق التي تقف دون استفادة المستثمر منها، وإيجاد حلول لها. ولتبيان ذلك تم الاعتماد على المنهج الوصفي التحليلي بالوصف الدقيق لمعلومات البحث وتحليل النص القانوني محل الدراسة من أجل تقييمه في نهايتها. ويبقى هذا القانون من أهم القوانين التي تساهم في خلق مناخ استثماري ملائم للاستثمارات الأجنبية. Abstract: Since its adoption of the market economy system, Algeria has developed a legal arsenal regarding investment development, the latest of which is Law 09/16 on its promotion, with the aim of attracting the largest amount of foreign investment. This study aims to highlight the various objective guarantees enshrined in this law, and the extent of its position on activating these guarantees in practice and the extent of its success in overcoming The obstacles that prevent the investor from benefiting from them and finding solutions to them. To demonstrate this, the descriptive and analytical approach was relied upon to accurately describe the research information and analyze the legal text under study in order to evaluate it at the end. This law remains one of the most important laws that contribute to creating an investment climate conducive to foreign investments
