الملخص
ملخص: تعد الشرعية الإجرائية المبدأ المهم في مجال القانون الجنائي، إذ لا جريمة ولا عقوبة إلا بنص، وهو ما يشكل ضمانة لحماية حقوق الأفراد وضمان حريتهم ، وخاصة في مرحلة إجراءات البحث والتحري وجمع الإستدلالات لأنها تعد المرحلة الجوهرية التي ينطلق منها البحث ومحاولة التعرف على الحقيقة في أقرب وقت ممكن ،مما يعرض ويقيد حقوق المشتبه فيه والتي لا بد أن تحفظ وتصان في هذه المرحلة. وعلى إثرها سارعت المديرية العامة للأمن الوطني بالجزائر بإبتكار طريقة خاصة ، أين عززت حقوق المشتبه فيه الموضوع في غرفة التوقيف للنظر، وذلك بوضع كاميرا مراقبة تعزز حقوقه وتحفظ كرامته ،أين زودت هذه الأخيرة بنظام إنذار ينبه الشرطي المراقب لكل ما يدور في الغرفة فترصد نسبة الحرارة والرطوبة و أوقات الزيارة وعرضه على الطبيب وحتى إنتهاء آجال توقيفه، كما يضمن تسجيل تقرير إجمالي قد يقدم كدعامة للجهات القضائية إن طلبت ذلك. Summary: Procedural legality is the important principle in the field of criminal law, as there is no crime or punishment except by a text, which constitutes a guarantee to protect the rights of individuals and ensure their freedom, especially at the stage of search, investigation and collection of evidence procedures because it is the essential stage from which the search and try to identify the truth as soon as possible, which exposes and restricts the rights of the suspect, which must be preserved and preserved at this stage. As a result, the General Directorate of National Security in Algeria hastened to devise a special method, where the rights of the suspect placed in the detention room were strengthened for consideration, by placing a surveillance camera that enhances his rights and preserves his dignity, where the latter was provided with an alarm system that alerts the policeman monitoring everything that is going on in the room, monitoring the percentage of temperature, humidity and visiting times and presenting it to the doctor until the end of the deadlines for his arrest, and also ensures the registration of a total report that may be submitted as a pillar to the judicial authorities if requested.
