التصرفات القانونية الارادية الواقعة على براءة الاختراع

الملخص
نتناول في هذا المقال التصرفات القانونية الإرادية الواردة على الحق في براءة الاختراع، بحيث يحق لصاحب براءة الاختراع سواء كان شخصا طبيعيا أو معنويا، التصرف فيها بعد إيداعها أو الحصول عليها من طرف الهيئة المختصة المتمثلة في المعهد الوطني الجزائري للملكية الصناعية، وتتمثل هذه التصرفات القانونية في التنازل بالبيع، تقديم براءة الاختراع كحصة في الشركة، الترخيص، الرهن، بحيث جعل المشرع الجزائري لكل هذه التصرفات أحكاما عامة تنظمها، نص عليها في القانون المدني، وقواعد قانونية خاصة تضمنها الأمر 03/07 المتعلق ببراءة الاختراع، حيث اشترط في هذه التصرفات وجوب توافر شروطا موضوعية وأخرى شكلية. ويترتب عن كل هذه التصرفات القانونية التي ترد على الحق في براءة الاختراع آثارا قانونية، تتمثل في الحقوق التي يتمتع بها صاحب البراءة، ، والتي تعود عليه بأرباح، باعتبارها وسائل فعالة لاستغلال براءة الاختراع، وعلى المجتمع وتطوره، بالإضافة إلى الالتزامات التي تقع على عاتقه بقوة القانون. In this article, we discuss the voluntary legal actions contained in the right to the patent, so that the owner of the patent, whether a natural or legal person, has the right to dispose of it after depositing or obtaining it by the competent authority represented by the Algerian National Institute of Industrial Property, and these legal actions are represented in Assignment by sale, submission of the patent as a share in the company, licensing, mortgage, so that the Algerian legislator made for all these actions general provisions regulating them, stipulated in the civil law, and special legal rules included in Order 07/03 related to the patent, as it stipulated in these actions that the availability of Substantive and formal terms. All these legal actions that respond to the right to the patent result in legal effects, represented in the rights enjoyed by the patentee, which accrue to him with profits, as effective means to exploit the patent, and to society and its development, in addition to the obligations that fall upon him strongly. the law.
