الطفل بين الكرامة القانونية والمهانة الاجتماعية

الملخص
الملخص: أن النزعة الإنسانية ترصد قيم التعارف والتقارب بين الشعوب. وتمثل الكرامة قيمة جوهرية تشترك فيها كل الثقافات وتجتمع عليها كل الأديان. ويأتي مفهوم الكرامة في أحيان كثيرة كمرادف لمفهوم الإنسانية وكأنه لا معنى للإنسان بدون صون وحماية كرمته. فشجرة القيم أصلها ثابت في الكرامة وتتفرع عن اغصانها سائر القيم المتبقية. فتحت مظلتها تقع الكثير من القيم: كالحرية. الإرادة والمساواة والمسؤولية وغيرها. والكرامة كحق تتقاطع فيه طبيعة النفس البشرية وقيم الدين وحقوق الأنسان بالمفهوم العالمي الحداثي. وبهذا يحمل مفهوم الكرامة البعدين معا الشعوري النفسي والعقل الاجتماعي. وكرامة الرجل تقوم من صون كرامته في طفولته ففي أعماق كل رجل طفل حسب طبيعة التربية والتنشئة الاجتماعية. فالكرامة قيمة أخلاقية تكبر مع الانسان وفق مختلف مراحله العمرية، تحفظها وترعاها مختلف مؤسسات التنشئة الاجتماعية وتحميها القوانين والأعراف السائدة في المجتمع. والكرامة من طبيعتها تتجاوز كل الاعتبارات العرقية والاثنية وحتى الدينية والعقدية لأنها تحمل البعد الأنسان في البشر. لذلك كانت مركز اهتمام من كل ثقافات الشعوب ومحاور رئيسي في مختلف التشريعات والقوانين المحلية والدولية. كما نصت عليها مبادئ ومواد معاهدات حقوق الأنسان العالمية. Abstract : The Humanism monitors the values of acquaintance and rapprochement between peoples. Dignity is a fundamental value shared by all cultures and all religions. The concept of dignity often comes as a synonym for the concept of humanity, as if there is no meaning for man without preserving and protecting his dignity. The tree of values has its root fixed in dignity, and all other remaining values branch out from its branches. Many values fall under its umbrella: such as freedom. will, equality, responsibility, and others. Dignity as a right in which the nature of the human soul, the values of religion, and human rights intersect in the modernist global concept. In this way, the concept of dignity carries both emotional, psychological and social dimensions. The dignity of a man is based on the preservation of his dignity in his childhood, in the depths of every man who is a child, according to the nature of education and socialization. Dignity is a moral value that grows with the human being according to his different stages of life, preserved and nurtured by the various institutions of socialization and protected by the laws and customs prevailing in society. Dignity by its very nature transcends all racial, ethnic, and even religious and doctrinal considerations because it carries the human dimension of human beings. Therefore, it has been the center of attention from all cultures of peoples and a major interlocutor in various local and international legislation and laws. It is also enshrined in the principles and articles of universal human rights treaties
