الملخص
ملخص: تعتبر الحضانة من أهم المسائل التي يفصل فيها قاضي شؤون الأسرة عند النظر في منازعات فك الرابطة الزوجية، التي نظمها المشرع الجزائري في المواد 62 إلى 72 من قانون الأسرة، حيث ركّز فيها على ضرورة حماية مصلحة المحضون من طرف قاضي شؤون الأسرة من خلال تقرير مجموعة من الحقوق للمحضون سواء ما تعلق منها بالجانب المادي، أو بالجانب المعنوي الذي يرتبط أساسًا بتربية المحضون على دين أبيه أي الإسلام من جهة، وحماية المحضون من الناحية الأخلاقية. لقد كرست المحكمة العليا هذه الحماية القانونية في العديد من قراراتها مؤكدة على وجوب ضرورة إيلاء مصلحة للمحضون أهمية قصوى لتحقيق الغاية التي ينشدها المشرع الجزائري من خلال الأحكام المنظمة للحضانة في قانون الأسرة مع الاهتداء بأحكام المادة 222 من قانون الأسرة في حالة غياب نص في هذا الأخير. Abstract: Custody is considered one of the most important issues that the family affairs judge settles upon when considering disputes concerning the dissolution of the marital bond, which was organized by the Algerian legislator in Articles 62 to 72 of the Family Code, in which he focused on the need to protect the interest of the child in custody by the family affairs judge through a report of a group of The rights of the foster child, whether related to the material aspect, or to the moral aspect that is primarily related to the upbringing of the child in the religion of his father, i.e. Islam, on the one hand, and the protection of the child in the moral aspect. The Supreme Court has enshrined this legal protection in many of its decisions, affirming that the interest of the child in custody must be given utmost importance in order to achieve the goal sought by the Algerian legislator through the provisions regulating custody in the family law, guided by the provisions of Article 222 of the Family Code in the absence of a text in the latter.
