الملخص
كثيرة هي الأحكام التي جاءت بها الشريعة الإسلامية للحفاظ على الحياة الزوجية وضمان ديمومتها، و استقرارها. فشرعت أحكاما قبل الزواج تمهيدا له، و بينت الحقوق والواجبات ورسمت الحدود. و في حال الخصام جعلت حلولا واقعية لتجنب الانفصال و حلِّ رابطة الزواج حفاظا على الأسرة. و إنما شرع الزواج ليدوم و يبقى و لا ينتهي إلا بموت أحد الزوجين. فإن تعذر ذلك لسبب من الأسباب كتب لهذا الزواج الفشل، السؤال الذي يريد البحث الإجابة عليه: ما دور تفعيل مقاصد أحكام الزواج في الشريعة الإسلامية في التقليل من فشله؟ و منه الحفاظ على الصلة و الميثاق الغليظ بين الزوجين. و لمَّا كانت الأحكام المتعلقة بالزواج كثيرة اجتهدت في اختيار ما رأيته أكثر ملاءمة لمحاور الملتقى من الأحكام. The provisions of the Islamic Sharia to preserve the family and ensure its continuity are so many , and the legal rulings that pave the way for marital life are evidence of this, as they demarcate the boundaries between them and show the rights and duties, in addition to trying to put realistic solutions in the event of conflict in order to avoid separation and the dissolution of the marriage bond, because it was legislated only for permanence and survival and not ending except with the death of one of the spouses or the impossibility of his survival for some reasons. This research has come to answer an important question in this aspect, which is: What is the role of activating the purposes of the provisions of marriage in Islamic law in reducing the failure of marriage, to preserve the bond and the strict covenant between the spouses? And since there are many rulings related to marriage, I tried hard to choose what I saw as more appropriate to the axes .
