حق الإنسان في توفير الأمن القضائي

الملخص
ملخص: يتسم الأمن القضائي بأهمية كبيرة وله دورٌ أساسي في ضمان حقوق الأفراد، ويُعد أهم أُسس بناء الدولة القانونية، ويعكس الثقة في المؤسسة القضائية والاطمئنان إلى ما يصدر عنها من أحكامٍ وقراراتٍ وأوامر قضائية، لأنّ القضاء السلطة الوحيدة التي تحمي حقوق الأفراد من التعدّي أو الانتهاك. وحماية الحقوق من قبل السلطة القضائية تكون بموجب الدستور، لأنّ الدستور هو الذي يحدد الضمانات التي تكفل حماية تلك الحقوق، ومن ثم يتحقق بوجود سلطة قضائية مستقلة وحيادية ويكون هدفها حماية حقوق الإنسان وتحقيق العدل والمساواة، وبذلك يتحقق الأمن القضائي. Abstract: Judicial security is of great importance and has a fundamental role in guaranteeing the rights of individuals. It is considered the most important foundation for building a legal state. It reflects confidence in the judicial institution and reassurance of its rulings, decisions and judicial orders, because the judiciary is the only authority that protects the rights of individuals from infringement or violation. The protection of rights by the judiciary is according to the constitution, because it is the constitution that determines the guarantees that guarantee the protection of those rights, and then it is achieved by the existence of an independent and impartial judiciary whose aim is to protect human rights and achieve justice and equality, and thus judicial security is achieved.
