الوصول الإنساني في بيئة النزاع ورهانات التفاوض مع الجماعات المسلحة

الملخص
ملخص: تستهدف هذه الدراسة إظهار أهمية تحقيق الوصول الإنساني في بيئات النزاعات الداخلية، وشرح كيفيّة تخطّي مختلف التحديات التي تفرضها طبيعة هذه البيئات خاصة فيما تعلق بتعدّد فواعلها وعدم رسمية بعضها، والتي منها الجماعات المسلحة، وهذا من خلال الاعتماد على "التفاوض من أجل الوصول الإنساني"، وعليه تسعى الدراسة أيضا إلى تبيان أهمية الأخير وكشف الرهانات المتعلقة به، انطلاقا من الإشكالية التالية: إلى أي مدى تعزّز جهود تفاوض الوصول الإنساني الناجحة لاسيما مع الجماعات المسلحة من قدرات تقديم المساعدات المنقذة للحياة في النزاعات المسلحة؟ لتصل في الأخير إلى أن المفاوضات لأجل الوصول الإنساني ليست بالسهلة وهي غالبًا ما تطرح إشكالات أخلاقية وعملية وقانونية، يسعى القانون الدولي الإنساني إلى جانب مختلف الفواعل الإنسانيين إلى تقويضها عبر إيجاد توازن بين المصالح العسكرية والأمنية للأطراف المتحاربة، بما فيها المجموعات المسلحة غير الحكومية، وبين الحاجة إلى تخفيف المعاناة الذي يبقى الهدف الأسمى. Abstract: This study aims to show the importance of achieving humanitarian access in environments of internal conflicts, and to explain how to overcome the various challenges posed by the nature of these environments, especially with regard to the multiplicity of actors and the informality of some of them, including armed groups, and this by relying on "negotiation for humanitarian access", Accordingly, the study also seeks to show the importance of the latter and reveal the challenges related to it, based on the following problem: To which extent such efforts to negotiate humanitarian access, especially with armed groups, enhance the capabilities of providing life-saving aid in armed conflicts? In the end, it concludes that negotiations for humanitarian access are not easy and often raise ethical, practical and legal problems. International humanitarian law, along with various humanitarian actors, seeks to undermine them by finding a balance between the military and security interests of the warring parties, including non-state actors, and the need for Alleviating suffering remains the ultimate goal.
