الملخص

ملخص: تعد الحماية الجزائية من أهم صور الحماية القانونية المقررة للوثائق والمعلومات الإدارية، نظرا لما تشتمل عليها من آليات، بعضها يرتبط بالشق الموضوعي من خلال تجريم مختلف السلوكات التي تشكل تعديا عليها وتحديد العقوبات المقابلة لها، والبعض الآخر يرتبط بالشق الإجرائي الذي يبين الإجراءات الخاصة التي ينبغي إتباعها في حالة وقوع الاعتداء عليها، والتي تتعلق بالاختصاص القضائي وكذلك بأساليب التحري الخاصة التي تحتل مكانة كبيرة في الدعوى العمومية لمساهمتها المباشرة في كشف مختلف الجرائم وضبط مقترفيها ومنع إفلاتهم من العقاب بإقامة الدليل فيها. وقد تضمن الأمر رقم 21-09 المتعلق بحماية المعلومات والوثائق الإدارية أحكاما جزائية خاصة من شأنها أن تعمل على منع وقوع الاعتداءات عليها ومكافحتها، كل ذلك من أجل ضمان المحافظة عليها وتجسيد المكانة التي تحظى بها بالنسبة للدولة ومؤسساتها. Abstract: Penal protection is one of the most important forms of legal protection prescribed for informations and documents administratives, according its mechanisms, some of them are related to the thematic part by criminalizing various behaviors that constitute an infringement of them and determining the corresponding penalties, and others are related to the procedural part that shows the special procedures that should be followed in case of infringement, procedures which are related to the judicial jurisdiction as well as to the special investigative methods that occupy a great place in the public lawsuit because of its direct contribution to uncovering various crimes, apprehending the perpetrators and preventing their impunity by establishing evidence in them. The order No. 21-09 concerning the protection of informations and documents administratives includes special penal provisions that prevent them and forbides any assault against them, all this so as to ensure its preservation and embody their value to the state and its institutions.
