الملخص
يقصد بآلية الدفع بعدم الدستورية حق الفرد في الاعتراض على تطبيق نصوص قانونية، قد تطبق في نزاع يكون طرفا فيه أمام إحدى الجهات القضائية، يرى أنها تمس حقوقا وحريات يضمنها له الدستور، غير أن ممارسته لهذا الحق مرهون بمدى توفر دفعه على شروط معينة، وكذا مروره على إجراءات تهدف إلى تصفية الدفع على مستوى الجهات القضائية بمختلف درجاتها، وهذا قبل إحالته على الهيئة المكلفة بمراقبة الدستورية، بما يوحي ظاهريا بتداخل عمل هذه الأخيرة والجهات القضائية في النظر في الدفع، وكان للاجتهاد الدستوري والفقهي رأيه الحاسم في توضيح وبيان سبل تدخل كل جهة في مجال الدفع بعدم الدستورية The mechanism of pleading unconstitutionality means the right of an individual to object to the application of legal provisions, which may be applied in a dispute to which he is a party before a judicial authority, which he believes affects rights and freedoms guaranteed to him by the Constitution, but his exercise of this right depends on the availability of his payment on certain conditions, as well as his passage through procedures aimed at liquidating the payment at the level of the judicial authorities of various degrees, and this before referring it to the body in charge of monitoring constitutionality, which ostensibly suggests the overlap of the work of the latter and the judicial authorities In considering the plea, constitutional and jurisprudential jurisprudence had its decisive opinion in clarifying and clarifying the ways of intervention of each party in the field of the defense of unconstitutionality.
