الحماية الجنائية من التلوث الضوضائي في التشريع الجزائري

الملخص
الملخص: يشكل التلوث الضوضائي اعتداء حقيقيا على حياة الأفراد، حيث يعد مصدر قلق لهم، وهو يعد من الأمور الملوثة للبيئة، هذا التلوث في الحقيقة لا يقل خطورة عن تلوث المياه والتربة والهواء، ومما لا شك فيه أن لكل إنسان في هذه الحياة الحق في أن يعيش حياة هادئة مطمئنة بعيدة عن الضوضاء والضجيج بحيث تسمح له في التفكير والعمل بهدوء، مما جعل من التلوث الضوضائي يلقى اهتماما بالغا على المستوى الوطني بعد تزايد معدلات الضوضاء بمختلف مصادرها وتفاقم آثارها، مما أدى إلى ضرورة توفير حماية جنائية من مخاطر التلوث الضوضائي ، وعليه اتجهت العديد من الدول ومنها الجزائر إلى توفير حماية جنائية موضوعية بما يتلائم مع متطلبات الشرعية الجزائية لمكافحته والحد من مختلف أشكاله . :Abstract Noise pollution constitues a real attack on the lives of individuals, as it is a source of concern for them, and it is one of the things that pollute the environment. In fact, this pollution is no less dangerous than the pollution of water, soil and air, and there is no doubt that every person in this life has the right to live a life Quiet, reassuring, far away from noise and noise, allowing him to think and work calmly, which made noise pollution of great interest at the national level after the increased rates of noise from its various sources and the exacerbation of its effects, which led to the need to provide criminal protection from the dangers of noise pollution, and accordingly many Countries, including Algeria, .have to provide objective criminal protection in line with the requirements of criminal legitimacy to combat it and limit its various forms
