التكييف القانوني للعقد الطبي

الملخص
ملخص: إنّ من بين مقتضيات كرامة الإنسان الحفاظ على حياته، فهي بمثابة درب تتخللها مشاكل مختلفة، ومن أهم المشاكل التي يخشى منها الفرد هي إعتلال صحته، مما يقتضي اللجوء إلى الطبيب لإزالة الدّاء وتقديم عِلاج يتسم باليقظة والتـّفاني، فإذا كان القصد من تدخل الطبيب بموجب العقد الطبي هو علاج المريض، فإنّ تنظيم العلاقة بين الطبيب والمريض وتحديد طبيعتها القانونية، لتعزيز عوامل الإطمئنان عند تحديد إلتزامات وحقوق أطرافها، بالخصوص المريض، إذ يبقى دائمًا طرفاً ضعيفًا بسبب تدهور صحته وإنفراد الطبيب بالعلم وفنون مهنته، بات أمرًا محتما ولإرتباط هذا العقد بصحّة الإنسان وشيوعه بين الناس. Abstract: Among the requirements of human dignity is the preservation of his life, as it is a path punctuated by various problems, and one of the most important problems that the individual fears is ill health, which requires resorting to the doctor to remove the disease and provide treatment characterized by vigilance and dedication. It is the treatment of the patient, regulating the relationship between the doctor and the patient and determining its legal nature, to enhance the factors of reassurance when determining the obligations and rights of its parties, especially the patient, as he always remains a weak party due to the deterioration of his health and the doctor’s monopoly with science and the arts of his profession. People.
