فعالية مؤسسات المجتمع المدني في الرقابة على العقود الاقتصادية

الملخص
الملخص: أمام شيوع العقود الاقتصادية فإن الطرف الضعيف يعتبر رجلا عاديا أمام المتعامل الاقتصادي كرجل محترف يمتلك المكنة المعلوماتية والمعرفية فضلا على المُكْنَةِ الاقتصادية والمالية بالمقارنة معه، وهو ما أظهر الاختلال في توازن العلاقة والذي فرض تدخلا تشريعيا حمائيا يعيد التوازن المفقود، وبهذا الخصوص فقد أولت مختلف التشريعات أهمية بالغة لمؤسسات المجتمع المدني باعتبارها هيئة مدنية غير حكومية تمثل المجتمع، وكونها حلقة لا يمكن إغفالها من أجل تحقيق حماية متكاملة مع باقي الأجهزة والهيئات الأخرى بما يحقق العدالة ويضبط سلوك المتعامل وكذا حماية الاقتصاد الوطني. الكلمات المفتاحية: العقود الاقتصادية، المجتمع المدني، اختلال التوازن، الرقابة. Abstract: In front of the prevalence of economic contracts, the weak party is considered an ordinary man in front of the economic dealer as a professional man who possesses the informational and cognitive hability as well as the economic and financial hability in comparison with him, which showed the imbalance in the relationship, which imposed a protective legislative intervention that restores the lost balance, and in this regard the various legislations have given importance A statement to civil society organizations as a non-governmental civil body that represents society, and as a link that cannot be overlooked in order to achieve integrated protection with the rest of the other agencies and bodies in a way that achieves justice and controls the behavior of the customer, as well as protecting the national economy.
