الضمانات الإجرائية لحماية مال القاصر في أحكام الولاية

الملخص
تُعدّ الولاية على أموال القاصر إحدى أهمّ وسائل الحفاظ على أمواله، ولذلك حظيت بتنظيم قانوني موضوعي وإجرائي نوعي شملته العديد من أنواع التّشريع في الجزائر، على أن يُراعى في ممارستها جوانب إجرائية جوهرية ينبغي أخذها بعين الاعتبار، لما تمثّله من ضمان لصون الأموال التي يبذل في إدارتها الوليّ عناية الرّجل الحريص، وإشراف قاضي شؤون الأسرة المختصّ إقليميّا على مراقبتها، مع ترتيب المسؤولية المدنية والجزائية في صورة ما تمّ المساس بهذه الجوانب، والتي تبقى رهينة النّص القانوني الذي يستدعي التّحيين تماشيا مع المستجدّات. The Guardianship over the minor's money is one of the most important means of preserving his wealth. Therefore, it has been received by a qualitative substantive and procedural laws that have been covered by many types of legislation in Algeria, In its exercise, substantial procedural aspects should be taken into account, as it represents a guarantee for the preservation of the funds made in the orderly management under the care of a diligent man, and by the supervision of the competent regional family affairs judge to monitor them, With the arrangement of civil and criminal responsibility in the event of prejudice to these aspects, Which remain hostage to the legal text that needs to be updated in line with the developments. La tutelle sur les fonds du mineur est l’un des moyens les plus importants de préserver son argent, et a donc été régi par un certain nombre de lois qualitatives de fond et de procédure couvertes par de nombreux types de législation en Algérie, en tenant compte des aspects procéduraux fondamentaux à prendre en considération. Parceque cela représente une garantie pour la sauvegarde des fonds gérés par le tuteur sous les soins d'un homme deligent, et la supervision du juge des affaires familiales compétent dans la région pour surveiller, avec l'arrangement de la responsabilité civile et pénale sous la forme de ce qui a été touché sur ces aspects, qui restent l'otage du texte juridique qui nécessite des mises à jour en fonction des développements.
