الملخص
الملخص: يعتبر الدستور المرجع في تنظيم العلاقة بين السلطات المنشأة ( السلطة التنفيذية ، السلطة التشريعية ، السلطة القضائية من قبل السلطات المنشئة ( السلطة التأسيسية الأصلية ، السلطة التأسيسية المشتقة )، ولقد أضفى المشرع الدستوري من خلال تعديل الدستور لسنة 2020 بإعادة تنظيم لهاته السلطات في إطار مبدأ الفصل بين السلطات المنصوص عليه في المادة 16 من الدستور ، والمحددة كذلك في عنوان الباب الثالث من الدستور في أربعة فصول بدءأ بمؤسسة رئيس الجمهورية ، الحكومة ، البرلمان والقضاء ، وهو إقرار بإعادة فصل ما بين الأجهزة ، وإعادة توزيع في الصلاحيات والأدوار ، ومن شأن الحديث عن الفصل الأفقي بين السلطات نبحث في ذات السياق عن العلاقة بين مؤسسة رئيس الجمهورية والحكومة والبرلمان ، وهو ما تناولته هذه الدراسة بالشرح لمظاهر الإستقلال ومظاهر التعاون وأدوات التوازن بين هاته السلطات لنستطيع فهم طبيعة الفصل الأفقي بين السلطات وتكييفه. Abstract : The constitution is the reference in regulating the relationship between the established authorities (the executive authority, the legislative authority, the judicial authority by the established authorities (the original constituent authority, the derived constituent authority), and the constitutional legislator added, through amending the constitution for the year 2020, to reorganize these authorities within the framework of the principle of separation Among the powers stipulated in Article 16 of the Constitution, and also specified in the title of Part Three of the Constitution in four chapters, starting with the institution of the President of the Republic, the government, Parliament and the judiciary, which is an acknowledgment of a re-separation of the agencies, and a redistribution of powers and roles, and talking about horizontal separation between the authorities. In the same context, we are looking for the relationship between the institution of the President of the Republic, the government, and the parliament. This is what this study aims to, by explaining the manifestations of independence, the manifestations of cooperation, and the tools of balance between these authorities, so that we can understand the nature of the horizontal separation between the authorities and adapt it.
