مفهـوم الدستورانية: مقاربـــــــة نظريــة

الملخص
إن الدستورانية باعتبارها مفهوماً مجرداً قد تحوي في مضامينها عدة أوجه ومعاني، فيمكن أن تتغير أوجه هذا المفهوم ومعانيه بتغير المجال أو السياق الفكري الذي يتم تناول هذا المفهوم من خلاله، فالدستورانية تعني من جهة تقييد السلطة وأعمال الحكومة، وتُعد أيضاً حركة موجهة لتحقيق مجموعة من الأفكار والقيم وتعتمد هذه الحركة على توافق الآراء على أساس أنها تمثل مذهباً أيديولوجياً وسياسياً من جهة أخرى، كما أن لمفهوم الدستورانية من جهة ثالثة جانب فلسفي وتاريخي فهو يتعامل مع اعادة تشكيل أفكار القانون الإلهي والطبيعي، والأصل التعاقدي للدولة، وطبيعة الأنظمة الديكتاتورية والديموقراطية...إلخ. هنا يظهر هدف هذه الدراسة وهو مقاربة مفهوم الدستورانية للإحاطة بمختلف وجوهه ومعانيه، ورصد خصائصه وسماته أيضاً. Abstract Constitutionalism as an abstract concept may contain several aspects and meanings. The aspects of this concept and its meanings can change according to the change of the field or the intellectual context in which this concept is addressed. The constitutionalism means in terms of restricting power and the work of government, and is also a movement directed to achieve a set of ideas and values. This movement is based on consensus on the basis that it represents an ideological and political doctrine on the other hand, and the concept of constitutionalism on the other hand has a philosophical and historical aspect that deals with the reshaping of the ideas of divine and natural law, the contractual origin of the state, the nature of dictatorship, democracy, etc. Here, the purpose of this study is to approach the concept of constitutionalism to identify various faces and meanings, and monitor its characteristics and features as well.
