الإطار القانوني للحق في بيئة سليمة Legal Framework For The Right To A Healthy Environment

الملخص
يهدف هذا المقال إلى دراسة الإطار القانوني للحق في بيئة سليمة، الذي يعتبر من أهم الحقوق والحريات الحديثة أو ما يعرف بحقوق الجيل الثالث،هذا الحق الذي تم التطرق إليه في المادة 64 من الدستور الجزائري المعدل، المصادق عليه باستفتاء أول نوفمبر 2020 والتي تنص على حق المواطن في بيئة سليمة وبالتالي على الدولة أن تقوم بواسطة مؤسساتها بالعمل على حماية هذا الحق والمحافظة عليه، وهذا ما يبين أن التعديل الدستوري الأخير جاء مجسدا وضامنا لحق المواطنين في العيش في بيئة سليمة مما ينعكس بالتبعية على باقي الحقوق والحريات، ذلك أن البيئة السليمة تساعد على التمتع بحياة مريحة وكريمة وبالرفاه والاستقرار وتحقيق الأمن بمفهومه الواسع، و بهذا تصبح الجزائر قد تداركت التأخر الفادح في النص على هذا الحق من جهة، والدخول في عهد جديد بموجب مقومات وانعكاسات هذا الحق من جهة أخرى . لنستنتج أنه ورغم هذا التنصيص الدستوري لا يزال هذا الحق مبهما ويحتاج إلى توضيح. This article seeks to study the legal framework of the right of a healthy environment, who is considered one of the most important modern rights and freedoms, or what is known " The right of the third generation ", that who is validated by the referendum of the 1st November 2020, which stipulates about the right of citizens in a healthy environment, consequently the state must to take action through its institutions to protect this right and save it, this is what shows that the amendment of constitution comes to embodies and guarantees of the right of citizens for living in a healthy environment, that is reflected in consequence on the others rights and Freedoms, cause the healthy environment helps to enjoy a comfortable and luxurious life, and the stability for achieving the real means of security, with this Algeria will have rectified the critical delay in providing for this right on the one hand, and entering into a new era according to the elements and implications of this right on the others hand, but despite this stipulation, this right still ambiguous and needs more clarification.
