حقوق الإنسان بين الحصانة والتقييد في الظروف الاستثنائية

الملخص
ملخص: قد تشهد الدولة ظروفا مستجدة غير عادية يمكن أن تتعلق بوباء يهدد الصحة العامة أو بحالة حرب أو بأزمة مالية تهدد الاقتصاد الوطني أو غيرها من الظروف الاستثنائية التي تعجز الدولة عن مواجهتها بالقوانين العادية، تلجأ الدولة الى إجراءات وقوانين جديدة واستثنائية، هذه الأخيرة لها إمكانية المساس بحقوق الإنسان وحرياته ، هذا الموقف يعد من أصعب وأخطر التحديات القانونية والعملية التي تواجه الدولة كونه مرتبط بحقوق الأفراد وحرياتهم ولخلق نوع من التوازن بين حقوق الإنسان وسلامة الدولة، كان المشرّع الدولي حاضرا من خلال فرض مجموعة من المبادئ أو القيود تكون حقوق الإنسان في هذا الوضع دائرة بين اكتساب نوع من الحصانة وعدم المساس ببعض الحقوق و إمكانية فرض مزيد من التقييد لفئة أخرى من حقوق الإنسان وحرياته. The state may witness unusual new circumstances that may relate to an epidemic that threatens public health, a state of war, a financial crisis that threatens the national economy, or other exceptional circumstances that the state is unable to confront with ordinary laws. Human rights and freedoms, this position is one of the most difficult and most dangerous legal and practical challenges facing the state as it is linked to the rights and freedoms of individuals and to create a kind of balance between human rights and state safety, the international legislator was present by imposing a set of principles or restrictions, human rights in this situation are between Gaining a kind of immunity and not violating some rights and the possibility of imposing further restrictions on another category of human rights and freedoms.
