حق الطفل في الحماية القانونية من الاستغلال الاقتصادي في التشريع الجزائري

الملخص
تأخذ الجوانب القانونية المتعلقة بحماية حقوق الطفل موضعا أساسيا من تشريعات مختلف الدول سواء في الحالات العادية أو الظروف الاستثنائية، وذلك من خلال الوضعيات التي قد يتعرض لها الطفل، فإذا كان الوضع الطبيعي لهذا الأخير هو الدراسة أو التعليم، فإن الظروف الاجتماعية والاقتصادية قد تدفع الطفل إلى ترك مقاعد الدراسة - متخليا في ذلك عن حقه في التعليم- والولوج إلى عالم الشغل والذي يمثل وضع غير طبيعي واستثنائي، وبحكم ضعف المركز القانوني للطفل في العلاقة القانونية التي تربطه مع المستخدم أو رب العمل، أولاه المشرع الجزائري عناية خاصة من خلال إحاطته بحماية قانونية منعا لأي شكل من أشكال الاستغلال الاقتصادي أو التشغيل غير القانوني، وتم تكريس هذه الحماية بدءا بتحديد السن القانوني للعمل، مرورا إلى منع تشغيل الطفل في ظروف غير لائقة، انتهاء بتقرير جزاءات قانونية على مخالفة الأحكام والضوابط الخاصة بتشغيل الأطفال . الكلمات المفتاحية: عمالة الأطفال، الاستغلال الاقتصادي، الحماية القانونية، الإجراءات القانونية لتشغيل الطفل، سن التشغيل. Abstract : The legal aspects related to the protection of children’s rights take an essential place in the legislation of various countries, whether in normal cases or in exceptional circumstances, and this is through the situation that the child may be exposed to, and if the normal situation for the latter is study or eduction, then the social and economic conditions may push the child to leave the school seats- giving up his right to education- and entering the world of work, which represents an abnormal situation and exceptional. And due to the weak legal status of the child in the legal relationship that binds him to the employee or the employer, the Algerian legislator gave him special attention by surrounding him with legal protection in order to prevent any form of economic exploitation or illegal employment, this protection has been devoted, starting with defining the legal age for work, through preventing child labor in inappropriate conditions, ending with determining legal penalties for violating the provisions and controls for child labor.
