الاستثمار العقاري في الاملاك الوقفية بالجزائر دراسة تطبيقية حول الوقف في وادي سوف

الملخص
الوقف في الإسلام يمثل أحد مظاهر الرقي الحضاري للأمة الإسلامية ، فالأملاك الوقفية تساهم في تغطية بعض جوانب احتياجات الأمة في كافة نواحي الحياة ،إلا أن النظرة الضيقة إلى الوقف على أنه مؤسسة دينية تعنى بشؤون المساجد والقائمين عليها فقط؛ أدى إلى تركيز الدراسات على البعد الديني، وانحسار دور الوقف في النواحي الدينية البحتة، وأن عدم الأخذ بعين الاعتبار أن الأموال والممتلكات الوقفية جزء مهم من ثروة الدول، يمكن أن توظف بما يخفف العبء عن موازنة الدولة في تقديم الخدمات التعليمية والاجتماعية والصحية وحتى خدمات البنية التحتية. فالعناية بالملك الوقفي لا تنحصر في التشجيع على الوقف فحسب، بل لابد من أن تتجه صوب إيجاد سلطة إدارية تسهر على الاستثمار فيه وكذا تنميته من اجل تأدية الغاية المرجوة منه وهو الأمر الذي دفع المشرع الجزائري الى مواكبة هذا التحول، ووضع سلسلة من النصوص القانونية، وذلك كله بغية ضمان السير الحسن لهذه الإدارة وفق توزيع مقنن لمهامها. إشراف الدولة ممثلة في وزارة الشؤون الدينية والأوقاف لاستمرارية رسالة الوقف في خدمة المجتمع الجزائري متوقف على تطوير النظام الإداري المسير للأوقاف. الكلمات المفتاحية: الوقف، الاستثمار الوقفي، الاملاك الوقفية، الجزائر، الوادي. Abstract: advancement of the Islamic nation. Endowment properties contribute to covering some aspects of the nation’s needs in all aspects of life. However, the narrow view of the endowment as a religious institution concerned with the affairs of mosques and those in charge of them only; This led to the focus of studies on the religious dimension, the decline in the role of the endowment in purely religious aspects, and the failure to take into account that endowment funds and properties are an important part of the wealth of countries , which can be employed in a way that reduces the burden on the state budget in providing educational, social, health and even infrastructure services . The care of the endowment property is not limited to encouraging the endowment only, but must be directed towards finding an administrative authority that ensures the investment in it as well as its development in order to achieve the desired goal of it, which prompted the Algerian legislator to keep pace with this transformation, and put a series of legal texts, and that All in order to ensure the smooth running of this administration according to a codified distribution of its tasks. The supervision of the state represented by the Ministry of Religious Affairs and Endowments for the continuity of the endowment message in the service of Algerian society depends on the development of the administrative system that runs the endowments.
