الأركان العامة لجريمة اختطاف الأطفال والعقوبات المقررة لها في قانون العقوبات الجزائري

الملخص
انتشرت ظاهرة اختطاف الأطفال من قبل أشخاص مجهولين، حيث يتم أخذهم من أمام مسكنهم؛ أو عند خروجهم من المدرسة، لقد استفحلت هذه الظاهرة ومست جميع الأعمار؛ ظهرت هذه الظاهرة في 2012 وكانت في تزايد مستمر ويختلف الغرض من وراء الاختطاف، فقد يكون الحصول على المال؛ أو نزع عضو من أعضاء الطفل من أجل الاتجار به؛ أو القيام باستغلال الطفل (تتعدد صور الاستغلال فقد يكون الاستغلال في الجنس أو في العمل). تدخل المشرع وقرر تجريم اختطاف الأطفال ونص على عقوبات صارمة تتماشى وخطورة هذه الجريمة، وذلك بموجب التعديل الذي أدخله على قانون العقوبات بقانون رقم 14-01 المؤرخ في 04 فبراير 2014، حيث اعتبر هذه الجريمة جناية معاقب عليها بعقوبة السجن المؤبد إذا ارتكبت باستعمال العنف أو التهديد أو الاستدراج أو غيرها من الوسائل، وتصل العقوبة إلى الإعدام إذا تعرض القاصر المخطوف إلى تعذيب؛ أو عنف جنسي؛ أو إذا كان الدافع إلى الخطف تسديد فدية؛ أو إذا ترتبت عنه وفاة الطفل. The legislator intervened and decided to criminalize the kidnapping of children and stipulated severe penalties consistent with the gravity of this crime, according to the amendment that he introduced to the Penal Code by Law No. 14-01 of February 04, 2014, where he considered this crime a felony punishable by life imprisonment if committed with the use of violence or threat Or solicitation or other means, and the punishment amounts to execution if the kidnapped minor is subjected to torture; sexual violence; if the motive for kidnapping is to pay a ransom; or if it results in the death of the child.
