الملخص

ان كل النشاطات في العصر الحديث تتداول عن طريق إبرام العقود بين الأفراد أو بينهم وبين الدول والهيئات، الا أن بعض الاستثناءات والحالات الطارئة كالحوادث والجوائح التأثير المباشر على مسار تنفيذ تلك العقود، سواء التأخير في تنفيذها، أو فرض تنفيذها على نحو مغاير لما اتفق عليه الأطراف، أو المنع من مواصلة تنفيذها أصلا. وهذا الوضع الذي فرض نفسه على أغلب الدول ومنها الجزائر استدعى ضرورة البحث في تكييف تدابير الوقاية وإعطاء الوصف الصحيح لمثل هذه الحالات الاستثنائية وايجاد الحلول المناسبة لها، من خلال تحديث الأحكام القانونية التي تنظم أثرها عند تنفيذ العقود، ودراسة مدى كفايتها وفاعليتها Abstract: All activities in the modern era are negotiated by concluding contracts between individuals or between them and between states and bodies, but some exceptions and emergency situations such as accidents and pandemics have a direct impact on the course of implementing those contracts, whether delaying their implementation, or imposing their implementation in a manner different from what the parties agreed upon. , or prevent its continued implementation in the first place. This situation, which imposed itself on most countries, including Algeria, called for the need to research the adaptation of prevention measures and give the correct description of such exceptional cases and find appropriate solutions to them, by updating the legal provisions that regulate their impact when implementing contracts, and studying their adequacy and effectiveness
