آليات مكافحة التمييز وخطاب الكراهية وفقا للقانون 05/20.

الملخص
ملخص: عرف المجتمع الجزائري في الآونة الأخيرة انتشارا كبيرا لأفكار تدعو إلى التمييز وتثير الكراهية بين فئات المجتمع، من خلال خطابات التحريض والتمييز والعنف، تهدف إلى زعزعة استقرار المجتمع وانسجامه ووحدته، لذا كان لزاما على المشرع الجزائري التدخل العاجل من أجل الحد من تفشي هذه الظاهرة وإصدار النصوص القانونية اللازمة لمكافحتها. فبالإضافة إلى قانون العقوبات نص الدستور على عزم الجزائر على مكافحة الفتنة والعنف والتطرف، وكذا كل أشكال التمييز وخطابات الكراهية، وعمل المشرع الجزائري على إصدار قانون خاص بالتمييز وخطاب الكراهية وهو القانون 20/05 المتعلق بالوقاية من التمييز وخطاب الكراهية ومكافحتهما، والذي استحدث صور جديدة لتجريم هذا النوع من الظواهر، ووضع آليات جديدة لمكافحتها سواء تعلق الأمر بالجانب الوقائي أو الجانب العقابي. Abstract: Algerian society has recently known a great spread of ideas calling for discrimination and inciting hatred between groups of society, through speeches of incitement, discrimination and violence, aimed at destabilizing society, its harmony and unity, so the Algerian legislator had to intervene urgently in order to limit the spread of this phenomenon and issue texts necessary to combat it. In addition to the Penal Code, the constitution stipulates Algeria’s determination to combat sedition, violence and extremism, as well as all forms of discrimination and hate speech. The Algerian legislator has issued a law on discrimination and hate speech, Law 20-05 on the prevention and combating of discrimination and hate speech, which introduced new forms of criminalization This type of phenomenon, and the development of new mechanisms to combat it, whether it comes to the preventive aspect or the punitive aspect.
