الملخص
الملخص: تمكنت الالتزامات المرتبطة بعقد البيع من جذب اهتمام الباحثين في القانون الخاص ، اذ أحيطت بالعديد من الدراسات و النقاشات ، كما و اهتمت بها غالبية التشريعات على غرار المشرع الجزائري ، من بين هذه الالتزامات التزام البائع بالمطابقة كالتزام يتزامن الحديث عنه عند تسليم المبيع ، اذ يرجع مفهوم الالتزام بالمطابقة الى ما اشارت اليه المادة 364 من القانون المدني الجزائري التي نصت " يلتزم البائع بتسليم الشيء المبيع للمشتري في الحالة التي كان عليها وقت البيع " و القول مطابقة المبيع للحالة التي كان عليها وقت البيع يحيل الى مطابقة المبيع للموصفات اي الصفات التي تميز بها وقت البيع ، فسميت بالمطابقة وصفية أو مطابقة المبيع للكم الذي تم الاتفاق عليه بين الطرفين و هي المطابقة الكمية ،كما أن للمطابقة وجه آخر و هو المطابقة الوظيفية ، اذ يلتزم البائع بتقديم مبيع يتوافق مع الاستعمال العادي أو الاستعمال المخصص له ، لقد تزايد خلال الآونة الأخيرة الحديث عن الالتزام بالمطابقة في البيوع التي تتم بناءا على تصاميم فمن الضروري تسليم المشتري عقار مطابق لما تم الاتفاق عليه بجميع مواصفاته ، كل هذا يدفع الى البحث في موضوع صور الالتزام بالتسليم المطابق مع ضرورة تحديد مضمونها بنوع من التفصيل. Astract: The obligations bound of the sale contract draw the attention of the researchers in the private law as she possesses a fertile ground for studies and discussions, and by the majority of the legislation , between these obligations the obligation of the seller of conformity an obligation coincides to speak when the delivery of the object of the sale; the concept of the obligation of conformity is aimed by the article 364 of Algerian Civil code "the seller is obliged to free to the buyer the object sold in the state where he was at the time of the sale" and to say in the state or he was at the time of the sale makes reference speak about the state of sold object the same one by its quality and there we let us be opposite in the descriptive conformity and by its quantity and this question refers to the quantitative conformity , even conformity to also corresponds to functional conformity wen the seller oblige to issue an object in accordance with the ordinary use and special use. The talker about the obligation of conformity has been growing interest recently with the acquisition of the real property on plan, passed on designs, all this made it necessary to study by a little detail the obligation of conformity in the field of the sales of real estate.
