الرقابة القضائية على عملّيات التسجيل في القوائم الانتخابية في ظل الامر 21-01 المتضمّن القانون العضوي المتعلّق بنظام الانتخابات الجزائري

الملخص
نظرا لأهمّية التسجيل في القوائم الانتخابية باعتبارها الركيزة الأساسّية التي تقوم عليها العمليّة الانتخابية وحجر الزاوية الذي يتوقّف عليه إتمامها، كونها شرطا أساسّيا لاكتساب صفة الناخب وشرطا مكمّلا لاكتساب صفة المترشّح، حيث لاوجود لها في غياب أحدهما؛ وبالتالي لن تتّم العملية الانتخابية بدون قوائم تعّد لهذا الغرض، ولا يمكن إعدادها في غياب ضمانات قانونية فعلّية، أهمّها الرقابة القضائية على قرارات اللجان المختصّة بإعدادها ومراجعتها، والتي يتوقّف إعمالها على توفّر جملة من الشروط والضوابط التي خصّها المشرّع الجزائري بأحكام قانونية خاصّة تعكس خصوصية هذا النوع من الرقابة، ولبيان هذه الأخيرة خصّت بهذه الدراسة. Given the importance of registration in the electoral lists as the basic foundation upon which the electoral process is based and the cornerstone upon which its completion depends, as it is a prerequisite for acquiring the status of a voter and a complementary condition for acquiring the status of a candidate, as it does not exist in the absence of one of them; onsequently, the electoral process will not take place without lists prepared for this purpose, and cannot be prepared in the absence of actual legal guarantees, the most important of which is judicial oversight over the decisions of the committees specialized in preparing and reviewing them, the implementation of which depends on the availability of a set of conditions and controls that the Algerian legislator singled out with special legal provisions that reflect the specificity of this type. From censorship, and to clarify the latter, this study was devoted to this study
