ضمانات التسجيل في القوائم الانتخابية في ظل الأمر رقم 21-01 المتضمّن القانون العضوي المتعلّق بنظام الانتخابات

الملخص
تكتسي عملّية التسجيل في القوائم الانتخابية أهمّية بالغة في النظام القانوني الجزائري لاسيما الانتخابي منه، باعتبارها شرطا أساسّيا لاكتساب صفة الناخب ومن ثمّ ممارسة حق الانتخاب، وشرطا مكمّلا لاكتساب صفة المترشّح ومن ثمّ ممارسة حق الترشّح، وبالتالي لن تتّم العملّية الانتخابية بدون قوائم تعّد لهذا الغرض، ولا يمكن إعدادها في غياب ضمانات قانونية فعلّية، على غرار الاعتراف بحق التسجيل في القوائم الانتخابية، والاعتراف بآليات للمحافظة عليه، التي خصّها المشرّع الجزائري بإحكام قانونية خاصّة تضمّنها الأمر رقم 21-01 المتضمّن القانون العضوي المتعلّق بنظام الانتخابات، والتي خصّت بوريقات هذا المقال. The registration process in the electoral lists is of great importance in the Algerian legal system, especially the electoral one, as it is a prerequisite for acquiring the status of the voter and then exercising the right to vote, and a complementary condition for acquiring the status of a candidate and then exercising the right to run for office. Therefore, the electoral process will not take place without lists prepared for this purpose. It cannot be prepared in the absence of actual legal guarantees, such as recognizing the right to register in the electoral lists, and recognizing mechanisms to preserve it, which the Algerian legislator singled out with special legal provisions contained in Ordinance No. 21-01 containing the organic law related to the electoral system, which was devoted to the papers of this article.
