الجرأة على الفتوى (أسبابها، عواقبها، علاجها)

الملخص
بحثي هذا أزعم أنه جاء لإيضاح منهج السلف الصالح في الفتوى والإفتاء، ولإيضاح خطورة من يتجرأ على الفتوى لما لها من الأثر الخطير على عقيدة المسلم ودينه وحتى على دنياه، وكذا لإعطاء العلاج لهذه الظاهرة . ومن أجل علاج هذه الظاهرة الخطيرة افتتحت بحثي بتعريف الجرأة على الفتوى، ثم تكلمت على شروط المفتي، كما تكلمت على هدي السلف الصالح في الفتوى، ثم تطرقت إلى أسباب الجرأة على الفتوى وعواقبها، ثم أعطيت بعض الأدوية لهذه الجرأة، ومن بين الأدوية التي ذكرتها: ضرورة الوقوف لهؤلاء المتطفلين على الفتوى بالمرصاد ومنعهم من الفتوى، ويكون ذلك أولا بوعظهم وتذكيرهم بخطورة مقام الإفتاء ووقوفهم بين يدي الله في يوم كان مقداره خمسين ألف سنة؛ فإن لم يتعظوا فعلى ولي الأمر أن يمنعهم من الفتوى ويهددهم وشهّر بهم حتى يُنَفِّر منهم الناس؛ فإن لم ينزجروا عليه أن يسلط عليهم العقوبة المناسبة، كالغرامة والضرب الحبس وغير ذلك، وإذا تسبب هؤلاء المفتين في ضرر مادي بسبب فتاويهم؛ فعلى ولي الأمر أن يجبرهم على تعويض من أفتوه وخاصة إذا كان هذا الضرر في النفس أو المال. Abstract : This research claim that it came to clarify the method of the righteous predecessors in fatwa and advisory opinion, and to clarify the danger of Ban jar over the fatwa because of its serious impact on the Muslim belief and religion and even on his life, as well as to give treatment to this phenomenon. In order to remedy this dangerous phenomenon, I opened my mission by introducing the audacity to the fatwa, then I spoke about the conditions of the mufti, as I spoke about the guidance of the righteous predecessor in the fatwa, then I touched on the causes of the audacity to the fatwa and its consequences, then I gave some medications to this audacity, and among the drugs that I mentioned: The need for these intruders to stand on the fatwa by the lookout and prevent them from the fatwa, and that is their first exhortation and reminding them of the danger of the Fatwa shrine and their standing in the hands of God on the Day of Resurrection, so if they do not obey, then the guardian should prevent them from the fatwa and with it. They will be repelled by a month, so if the people are not offended, then they will be subject to the appropriate punishment, such as fine, beating, imprisonment, etc., and if these muftis cause material harm due to their fat was, the guardian must compel them to compensate those who they have forgotten, and free if this harm is in the soul Or money.
