الحماية الجزائية للأملاك الوقفية في التشريع الجزائري

الملخص
يعتبر الوقف من أهم النظم في الشريعة الإسلامية التي تساهم في تحقيق التنمية الاقتصادية والاجتماعية، ونظرا لطبيعة الأملاك الوقفية التي قد تكون عقارات أو منقولات وما قد تتعرض له من اعتداءات واختلاسات ومختلف الجرائم التي قد ترتكب من القائمين عليها أو من أشخاص آخرين، لذلك من الضروري الحفاظ عليها وحمايتها لتحقيق دوام منافعها وتنميتها واستمراريتها، ومن أهم الطرق وأنجعها لحمايتها نجد الحماية الجزائية التي تقرر عقوبات لكل من يعتدي على هذه الأملاك الوقفية لتحقيق الردع العام والخاص، والتي قررها المشرع الجزائري في عدة قوانين، وعليه تناولت هذه الدراسة إشكالية مدى تحقيق هذه القوانين الجزائية للحماية المطلوبة للأملاك الوقفية لتساهم في تحقيق التنمية. الكلمات المفتاحية: الوقف; التنمية; الأملاك الوقفية; الحماية الجزائية. Abstract : The endowment is one of the most important systems in Islamic law that contribute to achieving economic and social development , In view of the nature of endowment properties that may be real estate or movables, Which may be exposed to assaults, embezzlement and many crimes that may be committed by those in charge of them or other persons, Therefore, it is necessary to preserve and protect it to achieve its benefits, development and continuity, One of the most important and most effective ways is the penal protection that prescribes penalties for anyone who infringes on these endowment properties in order to achieve public and private deterrence, Which was decided by the Algerian legislator in several laws, Accordingly. This study addressed the problem of the extent to which these penal laws achieve the required protection for endowment properties to contribute to achieving development.
