الملخص
تتناول هذه الدراسة خصوصية نظام المواريث في الشريعة الإسلامية وقانون الأسرة الجزائري، حيث نقف على مميزات هذا النظام وخصائصه مقارنة بالأنظمة الأخرى للميراث، ولا يخفى أن المشرع الجزائري إستمد نظام المواريث من الشريعة الإسلامية لذا سوف تقتصر الدراسة على خصوصية نظام الميراث وفق للشريعة الإسلامية من خلال محوريين أساسين نحدد في الأول مقاصد الشريعة الإسلامية من خلال نظام الميراث والثاني لخصائص نظام الإرث وفقا لها. This study deals with the specificity of the inheritance system in Islamic Sharia and Algerian family law, where we stand on the advantages and characteristics of this system compared to other systems of inheritance, and it is no secret that the Algerian legislator derived the inheritance system from Islamic law, so the study will be limited to the privacy of the inheritance system according to Islamic law through two axes In the first, we define the purposes of Islamic Sharia through the inheritance system, and the second is the characteristics of the inheritance system according to them.
