عقد الامتياز كأسلوب لدعم الإستثمار في المرفق العام وإشراك القطاع الخاص

الملخص
تتنوع العقود باختلاف أطرافها وهدفها ولعل أهم عقد يساهم في دعم الاستثمار هو عقد الامتياز باعتباره عملية إشراك للقطاع الخاص في تسيير المرافق العامة، ما يعني ترك الدولة لبعض من اختصاصاتها في تسيير المرفق العام إلى أشخاص من القطاع الخاص نظرا لعجزها عن ذلك أو امتلاك صاحب الامتياز لأساليب أحسن وإمكانيات مادية أدق واكبر. وبالتالي الانتقال من الدور التقليدي للدولة إلى دور حديث من خلال فرض الرقابة والتوجيه والبعد الكامل عن التعقيدات الإدارية التي لم تساهم أبدا في تطور المرافق العمومية. وبهذا يكون عقد الامتياز أسلوب مهم للاستثمار في البنى التحتية من اجل تحقيق الربح إذ يعتبر هذا الأخير المحرك الرئيسي للمستثمر مقابل الاستغلال المباشر للمرفق كما انه يتحمل كل المخاطر سواء المالية أو التقنية. Abstract : Contracts vary across parties and their purpose. perhaps the most important contract contributing to investment is the concession contract as a process of involving the private sector in the management of public utilities; this means that the state leaves some of its competence to operate the public facility to the private persons because of its inability to do so or because the concessionaire has better methods and greater material. Thus moving from the traditional role of the state to modern one through censorship,guidance and a complete distance from administrative complications that have not contributed to the development of public facilities. The concession contract is thus an important way to invest in infrastructructure for profit. The main driver of the investor versus direct exploitation is the facility and it bears all the risks;both financial and technical.
