التصور الاسلامي للجريمة: تشخيص للأسباب وتقديم للحلول

الملخص
لا شك أن تفسير الجريمة في المجتمع الجزائري لا يحتاج إلى استيراد النظريات الغربية لتفسيره، لأن ثمة تفسير للجريمة يرتبط بالمجتمع المسلم وثقافته الخاصة، ذلك هو التصور الإسلامي للجريمة والذي لم يقف عند تشخيص عوامل الجريمة فحسب بل سعى إلى تقديم حلول لعلاج الجريمة والوقاية منها. فعوامل الجريمة حسب التصور الإسلامي هي عوامل ذاتية تتعلق بالفرد المسلم وأخرى اجتماعية تتعلق بمحيطه الاجتماعي ، أما الحلول التي قدمها لمكافحة الجريمة فكانت على مستويين، حلولا فبلية تعمل على الوقاية من الجريمة قبل وقوعها وأخرى بعدية تعمل على معالجة الجريمة بعد حدوثها. عوامل وحلول ستسعى هذه الورقات البحثية لتقصيها. Abstract: There is no doubt that the interpretation of crime in Algerian society does not need to import Western theories to explain it, because there is an explanation of crime that is linked to the Muslim community and its own culture. This is the Islamic conception of crime, which did not stop at diagnosing the factors of crime only, but sought to provide solutions for the treatment and prevention of crime. The factors of crime, according to the Islamic perception, are subjective factors related to the Muslim individual and social factors related to his social environment , As for the solutions he presented to combat crime, they were on two levels: prior solutions that work to prevent crime before it occurs, and posterior solutions that work on treating crime after its occurrence. factors and solutions that this research will seek to answer.
