جريمة العنف اللفظي والنفسي ضد الزوجة في التشريع الجزائري والعراقي

الملخص
نظرا لخطورة العنف اللفظي والنفسي على الزوجة والأسرة تدخل المشرع الجنائي بتجريمه والعقاب عليه، ومن هنا تظهر أهمية هذا البحث الذي يهدف إلى تحديد الأفعال التي تشكل جريمة العنف اللفظي والنفسي ضد الزوجة، وإجراءات المتابعة، والجزاءات المقررة لهذه الجريمة، فكيف عالج المشرع الجنائي الجزائري والعراقي جريمة العنف اللفظي والنفسي ضد الزوجة، وهل ذلك كفيل بحماية الأسرة؟ توصلنا من خلال هذا البحث إلى مجموعة من النتائج أهمها: -الاعتماد على نص التجريم والعقاب وحده لن يحقق الغاية منه، لأن هذا الجريمة مرتبطة بأفكار وعادات وأعراف اجتماعية، تحول دون تحقيق النصوص الجنائية لأهدافها. -بل يجب وضع إستراتيجية متكاملة، تشارك فيها مختلف القطاعات الحكومية المعنية، والجمعيات الحقوقية، والأئمة، والمؤسسات التعليمية، ووسائل الاتصال، حتى تزول جميع المعوقات. Abstract: The dangers of verbal and psychological violence angainst the wife and family, pushed the criminal legislator to intervene criminalizing and punishing for it, hence this research aims to identify the acts that represent a crime of verbal and psychological violence against the wife, in addition to the procedures, and the penalties prescribed for this crime. This research raises the following problem: How did the Algerian and Iraqi criminal legislator treat the crime of verbal and psychological violence against the wife, and does these guarantee the protection of the family? Through this research, we reached a number of results, the most important of them are: relying on the text of criminalization and punishment alone will not achieve its purpose, because this crime is linked to ideas, customs and social norms that prevent criminal texts from achieving their goals. Rather, an integrated strategy must be developed, with the participation of the various concerned government sectors, human rights associations, imams, educational institutions, and means of communication, in order to remove all the obstacles.
