حرية الإعلام والحق في الحياة الخاصة

الملخص
إن الحق في الحياة الخاصة من الحقوق الشخصية والتي لم يتم إيجاد تعريف لها لحد الساعة والتي تستوجب الضبط لحمايتها، وكما يعد حق الجمهور في الإعلام من المظاهر المقيدة لهذا الحق شريطة الإلتزام بالأخلاقيات الإعلامية، ونقترح كذلك تعديل المادة 303 من قانون العقوبات وإضافة عبارة المكان العام إذ أن الحماية لم تعد تقتصر على المكان الخاص في هذا العصر، فالمكان العام له كذلك خطورته، فهذا معناه أن الشخص عرضة للتعدي حتى ولو كان في مكان عام. و تزول خاصية التجريم عن الحق في الحياة الخاصة عند وجود ظروف استثنائية وعند توفر ركن رضاء صاحب الحق مع وجوب مراعاة حدود مشروعية الرضاء كسبب لإباحة المساس بهذا الحق، وكذا القيد الثالث أن يتعلق بالإثبات والإعلام. Freedom is not absolute, but is relative .It is limited to what guarantees the security and tranquility of society. Therefore, a balance has to be made between public order and individual freedoms, which requires setting disciplines or what are termed restrictions. The right to private life is considered one of the personal rights for which definition has not been established, which requires control to protect it. The public s right to media is one of the limiting aspects of the said right, provided to media ethics. As the right of the public to the media is a restricted manifestation of this right provided that the media ethics are adhered to, we also propose to amend article 303 of the Penal Code and add the term public place since protection is no longer limited to the private place in this era, because the public place is also dangerous, meaning that the person is vulnerable to abuse even if he is in a public place. The criminalization for the right of private life is removed when exceptional circumstances, exist, and when the right holder element of consent exists, taking into account the limits of the consent legitimacy as a reason for permitting the violation of this right, as well as the third restriction to be related to evidence and information.
