الملخص
ملخص: أخذ المشرع الجزائري بنظام الإزدواجية القضائية منذ دستور 1996، الذي جاء نتيجة لمجموعة من الإصلاحات التي تمس السلطة القضائية، وإحداث هيكل قضائي متخصص بالنظر في منازعات الإدارة، وعلى إثر ذلك جاءت هذه الدراسة تهدف للبحث عن دور القاضي الإداري في دعوى الإلغاء، نظرا للمساهمة المحورية للقاضي الإداري في تكريس دعائم دولة القانون، وحماية حقوق الأفراد. بإيجاد قضاء إداري متخصص يكون المشرع الجزائري قد ساهم في رسم معالم الطريق الذي يتخذه المتضرر من القرار الإداري المعيب، وذلك من خلال معرفة وسائل الطعن الممكنة والمتاحة للأفراد والتي يمكن من خلالها مخاصمة القرار الإداري، والجهات القضائية الإدارية المتخصصة بمراقبة مشروعية الأعمال الإدارية القانونية والتي تحدث أثارا قانونية سواء بالإنشاء أو التعديل أو الإلغاء. Abstract: The Algerian legislator has adopted a system of judicial duplication since the 1996 constitution, which came as a result of a set of reforms affecting the judiciary, and the creation of a specialized judicial structure to consider management disputes, and as a result of this study came to search for the role of the administrative judge in the cancellation lawsuit, given the pivotal contribution of the judge administrative in dedicating the foundations of the rule of law, and protecting the rights of individuals By finding a specialized administrative judiciary, the Algerian legislator has contributed to drawing the milestones of the path taken by the victim of the defective administrative decision, by knowing the means available to individuals through which the administrative decision can be contested, and the administrative judicial authorities specialized in monitoring the legality of legal administrative actions that have legal effects, whether create, amend or cancel.
