مسائل الحيل في النكاح والطلاق -دراسة تطبيقية-

الملخص
الملخص: رغب الإسلام في الزواج، وجعله من العقود المؤبدة، وبناه على المودة والمحبة إلا أنه قد يحدث الخلاف والشقاق بين الزوجين، وتستحيل المعاشرة الزوجية بينهما، فجعل الله لذلك مخرجا، وهو الطلاق. فالحيل في الزواج تهدف إلى المحافظة على ديمومة المعاشرة الزوجية واستمرارها، وتفاديا لبعض الخلافات التي قد تحدث بين الزوجين أبيح لهما أن يشترطا في عقد الزواج شروطا، مثل حيل عقد الزواج المقترن بشرط، كاشتراط الزوجة على زوجها أن لا يتزوج عليها، أو أن لا يخرجها من بلدها، وكذا حيل زواج التحليل عند من يرى بجوازه، فهي تهدف إلى المحافظة على الأسرة. أما الحيل في الطلاق بنوعيه، حيل الطلاق المنجز، وحيل الطلاق المعلق على شرط فهي مخارج لوقوع الطلاق، فهي تهدف إلى إبقاء الحياة الزوجية قائمة، وتجنبها من الانفصال والانشقاق. Summary : Islam wanted us to marry, and make it like a perpetual contract, and build on affection and love, but there may be splits and differences between couples, and marital cohabitation is impossible between them, so god made for us a way out, it is divorce. The trick in marriage is to maintain the permanence of marital cohabitation, and to avoid some of the differences that may occur between couples, allow them to put conditions in the marriage contract such as a marriage contract associated with a condition, like the wife’s requirement that her husband not marry a second wife, or that does not bring her out of her country, or the tricks of marriage analysis at those who see his passport, they are designed to preserve the family. Either the tricks of divorce in two types, tricks of divorce completed, tricks divorce suspension on terms, they are exits for divorce, in the end, these tricks are designed to keep married life alive, and avoid them from secession and schism.
