الجزاءات غير الجنائية ومدى فاعليتها في الحد من خطورة الجرائم الاقتصادية

الملخص
تعتبر الجرائم الاقتصادية من أهم وأخطر التحديات التي تواجه السياسات الاقتصادية للدول، فهي جرائم تهدد النمو الاقتصادي وذلك بالنظر الى تنوعها وتطورها المستمر، لذا عمدت الكثير من الدول الى تبني سياسة ردعية صارمة لمواجهتها تتميز بالتنوع بين جزاءات منصوص عليها في قانون العقوبات وأخرى لا مثيل لها في هذا القانون، والمتمثلة أساسا في جزاءات مدنية وادارية تأديبية وفنية، للحد من الاثار السلبية لهذه الجرائم، وهنا نتساءل عن مدى فاعليتها في الحد من العوامل الدافعة الى ارتكاب هذا النوع من الجرائم. فالجزاءات غير الجنائية في الجرائم الاقتصادية تشكل منظومة ردعية متكاملة تتلاءم مع طبيعة هده الجرائم وخصوصيتها، وكذا مرتكبيها لأنه في الكثير من الافعال غير المشروعة التي يقوم بها الجناة تحتاج إلى تدخل جهات إدارية دون انتظار المتابعات القضائية الطويلة، التي قد تفوّت فرصة محاصرة هذه التصرفات والتقليل من آثارها السلبية مع الحفاظ على حقوق كل الأطراف من خلال رقابة القضاء على كل الإجراءات لتجنب تجاوزات الإدارة التي هي ليست بعيدة عن مظنة التعسف. Economic crimes are considered one of the most important and most serious challenges facing the economic policies of countries. They are crimes that threaten economic growth, given their diversity and continuous development. Therefore, many countries have adopted a strict deterrent policy to confront them, characterized by the diversity between penalties stipulated in the Penal Code and others unparalleled in the This law, which is mainly represented in civil, administrative, disciplinary and technical penalties , to reduce the negative effects of these crimes, and here we wonder about the extent of its effectiveness in reducing the factors that motivate the commission of this type of crime . sanctions in economic crimes constitute an integrated deterrent system that is compatible with the nature and privacy of these crimes, as well as the perpetrators, because in many of the illegal acts committed by the perpetrators, the intervention of administrative authorities without waiting for long judicial follow-ups that may miss the opportunity to besiege these actions and reduce their effects Negativity while preserving the rights of all parties through judicial oversight of all procedures to avoid the administration's excesses, which are not far from the suspicion of arbitrariness
