الملخص
تمنح شهادة الترقيم العقاري المؤقت في القانون الجزائري لفائدة الأشخاص الذين تسجل العقارات باسمهم بمناسبة عمليات المسح العام للأراضي دون أن تتوفر لديهم سندات ملكية رسمية، فهي وثيقة قانونية مدعمة للحيازة وصالحة لمدة قانونية محددة وذلك من أجل التثبت من حق الملكية و تسهيل استغلال العقار إلى حين استلام الدفتر العقاري من جهة، و السماح لذوي المصلحة بتقديم اعتراضاتهم على تسليمها من جهة أخرى. و يهدف هذا البحث إلى تسليط الضوء على شهادة الترقيم العقاري المؤقت في القانون الجزائري باعتبارها وثيقة إدارية تسلمها إدارة المحافظة العقارية المختصة إقليميا للمالكين الظاهرين بمناسبة إيداع الوثائق المسحية من خلال تحليل النصوص التشريعية والتنظيمية المتعلقة بالموضوع وعليه نعتمد على المنهج الوصفي التحليلي. The provisional land registration certificate under Algerian law is granted for the benefit of persons in whose name real estate has been registered, following general land registration operations, without having authentic property titles. It is a legal document that reinforces possession and is valid for a specific legal period, in order to ensure ownership and facilitate the exploitation of the real estate until the land register is received on the one hand, and to allow the parties involved to submit their objections to its issuance on the other hand. The present research aims to shed light on the provisional land registration certificate in Algerian law as an administrative document issued by the territorially competent land registry administration, to the owners who manifest themselves following the filing of the land registry documents, and this through the analysis of the legislative and regulatory texts relating to the subject, and for this purpose we have used the descriptive analytical approach.
